This one was seeming pretty good until this part;

"The attack hits automatically..."

Ignoring the fact I don't see why it should be an auto hit... the fact that the poison spit is an auto-hit isn't actually too bad since the damage is kept reasonable. And if the poison was reasonably low, forcing a Fort save vs poison for simply being close could work. But 1d10 Con isn't anything to sneeze at, it's just too high of a number for something that takes no effort on your part, no action cost, and effectively never misses.
